New organization working for prompt payment in construction
Toronto, ON – Representatives from across the entire construction industry have come together to form a new organization committed to getting legislation that would see contractors get paid for completed and certified work within a defined and prompt timeframe.
Prompt Payment Ontario (PPO) currently has 34 construction associations, unions and pension funds that have so far signed on as paid members and continues to welcome new members from all parts of the construction industry.
The new organization was formed after the provincial government set aside consideration of Bill 69, a private member’s bill that would have legislated prompt payment for the construction industry in favour of a comprehensive independent review of the Construction Lien Act (CLA) last spring.
The government announced yesterday that the review will be chaired by Bruce Reynolds, a partner with law firm Borden, Ladner, Gervais. Reynolds will be supported in the review by Sharron Vogel. PPO is encouraged by the inclusion of prompt payment issues as an integral part of this review.
“We welcome the opportunity to work with the review and are optimistic that it will bring about much needed change in the industry. Trade contractors are typically not being paid for several months for completed construction work and they still have to meet payroll, pay taxes, WSIB premiums, and on behalf of their employees’ benefit and pension plan contributions; all on time,” said Eryl Roberts, President of PPO. “Delinquent payment has become the norm in our industry. It’s an unfair transfer of financial risk. A review of the Construction Lien Act that incorporates prompt payment terms would have an immediate and positive impact on both job preservation and new job creation.”
